AA Max Quality Construction Proposal
Recommendation
By Minute Motion, that the board ratify Contract Amendment No. 1 in an
amount not to exceed $2,600 to AA Max Quality Construction (Contract
No. R30570B) for landscape modifications at 77115 Florida Avenue, Palm
Desert (NSP). Funds for this service is available in Account No. 703-
4496-464-4001.
Executive Summary
The Successor Agency's Executive Director authorized staff to contract with AA Max
Quality Construction to modify the existing front yard's landscape that includes removal
of some overgrown shrubs and installation of new materials providing differentiation of
current 1" tan/pink rock covering most of the yard as well as drought tolerant plants and
vines. Approval of staffs recommendation will ratify an amendment to the contractual
services agreement in the amount not-to-exceed $2,600 with AA Max Quality
Construction.
Background
As part of Palm Desert's participation in the Neighborhood Stabilization Program we
acquired two homes including 77115 Florida Avenue. The projects are both nearing
completion and will be readied for sale.

As part of the rehabilitation for 77115 Florida Avenue, the landscape was only included
to the extent that the existing landscape would be "cleaned up". After removal of dead
materials and clean up, it is clear that additional plants and work is needed in the front
yard to stay consistent with the surrounding homes. The proposal includes removal of
fence, old trees, bushes, some ground cover and installation of ground covers, vines,
agaves and rocks. Staff is working with the Landscape Department to confirm full
compliance.
Therefore, Staff recommends that the Successor Agency ratify Amendment No. 1 with
AA Max Quality Construction.
Fiscal Analysis
The fiscal impact is the cost of the change order which will be charged to ROPS-2,
Project Area #4, line item #21.

SUBJECT: Change Order No. 1 - 77115 Florida Avenue, Palm Desert (NSP)
As part of Palm Desert's participation in the Neighborhood Stabilization Program we
acquired two homes including the one noted above. The projects are both nearing
completion and will be readied for sale.
As part of the rehabilitation for the above home, the landscape was only included to the
extent that the existing landscape would be 'cleaned up'. After removal of dead
materials and clean up, it is clear that additional plants and work is needed in the front
yard to stay consistent with the surrounding homes.
I have attached two proposals from the current contractor for the front yard landscape
that includes removal of some overgrown shrubs and installation of new materials
providing differentiation from the current 1" grey rock covering most of the yard as well
as drought tolerant plants and vines.
The two proposals are $3,400 and $2,600 respectively with the difference being less
plants. I recommend that we process a change order for $2,600 for the modifications to
the front landscape since funding is limited.
This will go to the Successor Agency on August 23, 2012 as a ratification of your
approval of Change Order No.1 to the contract to AA Max Quality. Upon execution, if
necessary, we will provide the information to the Oversight Board at an upcoming
meeting. This will be charged to the Project Area #4 ROPS line 21.

This Contract Amendment covers changes to the subject contract as described herein. The consultant shall perform
all work as necessary or required to complete the Contract Amendment items for a lump sum price agreed upon
between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as Owner.
Contract Time Extension -0- Days.
Revised Contract Total $44,324.00
The undersigned Consultant approves the foregoing Contract Amendment # 1 as to the changes, if any, in the
contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to
the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said
Contract Amendment # 1 . The Consultant agrees to furnish all labor and materials and perform all other necessary
work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Contract
Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is
understood that the Contract Amendment shall be effective when approved by the Owner.
Execution of this Contract Amendment by the Consultant constitutes a binding accord and satisfaction that fully
satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity,
arising out of or related to the subject of the Contract Amendment, whether known or unknown, including but not
limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of productivity, as well
as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items include above
must have required signatures as per the purchase resolution.
