Award Contract No. C 33030 for the EI Paseo Median Electrical Retrofit project to Cove Electric, Inc., in the amount of $58,525; 2. Authorize the Director of Finance to set aside a 10 percent contingency in the amount of $5,852.50; 3. Appropriate $64,377.50 from unobligated General Funds to Account No. 400-4614-454-4001, Capital Reserve Landscape; 4. Authorize the City Manager to draft a reimbursement agreement between the City and Successor Agency authorizing payment from any Successor Agency funding source available for this purpose; and 5. Authorize the Mayor to execute the contract agreement. Backqround At the request of City Council, staff investigated the requirements to upgrade the existing electrical on the EI Paseo median between Highway 74 and Portola Avenue to meet the electrical needs for additional holiday decorations. Staff Report Award Contract No Page 2 of 3 August 22, 2013 C 33030 for EI Paseo Median Electric Retrofit Staff prepared specifications and on August 1 and 7, 2013, the City Clerk advertised the Notice Inviting Proposals. On August 12, 2013, proposals were received from two electrical contractors as follows: Contractor Location Bid Amount Cove Electric, Inc. Palm Desert, CA $58,525 West Bound Electrical Palm Desert, CA $59,945 These proposals were evaluated by staff for completeness, company qualifications, experience, required drawings, and locality of the company. Each contractor's design appeared to meet the project criteria although each presented a different design solution. Both companies received the exact same proposal score, therefore, staff opened the cost proposals and as shown above Cove Electric, Inc., was the low proposer. Engineering staff who participated in the evaluation process preferred the design presented by Cove Electric, Inc, and recommends that City Council award the contract to Cove Electric, Inc. Fiscal Analysis Although the General Fund would initially advance the funds for this work, it is the intention of the Successor Agency to reimburse the City for the costs. WITNESSETH RECITALS: CONTRACTOR has submitted to CITY its Contractor's Proposal for the construction of CITY Project, 1. EI Paseo Median Electrical Retrofit Project, Project No. 790-14, in strict accordance with the Contract Documents identified below, CITY has accepted said Proposal. 2. CONTRACTOR states that it has re-examined its CONTRACTOR'S Proposal and found it to be correct, has ascertained that its Subcontractors are properly licensed and possess the requisite skill and forces, has examined the site and Contract in accordance with the Contract Documents for the money set forth in its Proposal to be paid as provided in the Contract Documents. AGREEMENT: IT IS AGREED BY THE PARTIES AS FOLLOWS: 1. Contract Documents: The entire contract consists of the following: (a) The Agreement; (b) The Notice Inviting Proposals; (c) The Instruction to Proposers; (d) The Contractor's Proposal; (e) The Performance Bond; (f) The Payment Bond; (g) The General Specifications; (h) The Special Provisions; (i) The Standard Specifications as modified in other portions of the Contract Documents; (j) The Drawings; (k) Addenda Nos. none; (I) Any Change Orders issued; (o) Any additional or supplemental specifications, notices, instructions and drawings issued in accordance with the provisions of the Contract Documents. All of said Documents presently in existence are by this reference incorporated herein as if here set forth in full and upon the proper issuance of their documents they shall likewise be deemed incorporated. 2. Contractor shall commence the work within ten calendar days after the date of the Notice to Proceed and will do all things necessary to construct the work generally described in Recital No. 1 in accordance with the Contract Documents and will complete said work within 45 Calendar Days from the Notice to Proceed date to the satisfaction of the Engineer. 3. Contractor agrees to indemnify, defend and save CITY and its officers, agents and employees, and the Engineer harmless from: Contract No. C33030 a. Any and all liability, claims, damages, losses or injuries to any person or other entity, including injury to Contractor's employees, and all claims which arise from or are connected with the negligent performance of or failure to perform the work or other obligations of this Agreement, or which are caused or which are claimed to be caused by the negligent or intentional acts or omissions of Contractor, its subcontractors, its agents or employees, and, all expenses of investigating and defending against same, b. Any and all liability, claims, damages, losses or injuries to any and all contractors, subcontractors, material-men, laborers, or any other person, firm or corporation furnishing or supplying work, services, materials or supplies in connection with the performance of the Agreement. c. Attention is directed to the General Specifications - Claims, Liability, and Indemnity Agreement/Hold Harmless sections, which specifications are made part of this Agreement as set forth in Agreement paragraph 1, above. d. Attention is directed to Section 6-9, "Liquidated Damages" of the Standard Specifications and is hereby amended to substitute the "City of Palm DeserY' in place of "Agency." Liquidated damages shall be $1,000.00 dollars per calendar day of delay. 4. Should any litigation or arbitration be commenced between the parties concerning the works of improvements as referenced herein, the prevailing party in any such litigation, being the CITY or the Contractor, should be entitled to a reasonable sum for attorney's fees incurred in any such litigation relating to this Contract. 5. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors, and assigns. 6. Contractor shall be paid in the manner set forth in the Contract Documents the amount of its Proposal as accepted by CITY, subject to such additions and deductions as may be made pursuant to the Contact Documents and applicable law. Satisfactory Performance: The prime Contractor agrees to pay each Subcontractor under this prime contract for satisfactory performance of its contract no later than 10 days from the receipt of each payment the prime Contractor receives from City of Palm Desert. Any delay or postponement of payment from the above referenced time frame may occur only for good cause following written approval of the City of Palm Desert. Release of Retention: The prime Contractor agrees further to release retention payments to each Subcontractor within 30 days after the Subcontractor's work is satisfactorily completed. Any delay or postponement of payment from the above Contract No. C33030 7. (760)360-7895 Fax License # C-10 397002 � City of Palm Desert El Paseo median electrical retrofit — project 790-14 Cove Electric shall provide to the city of Palm Desert, a total of 54 functioning, GFCI ""' protected receptacles located within the El Paseo median to accommodate approximately 72 individual trees with one amp of available load for each individual tree, and no more than ,,,,�, twenty feet away from any one tree. (actual distances most likely within ten feet.) Because of extreme distances from the power source, a 277-volt boost transformer shall be installed at two power sources. One will be installed at the 100-amp pedestal located on the corner of hwy. 74, �"' the other at the 70-amp load center located within the median between San Luis Rey, and Portola. Additionally, there will be a total of nine step down transformers with integral r,;,, overcurrent protection ranging in size from one to five KVA located at various points along the medians. These transformers will provide the 120-volt power to each tree at less than 3% voltage drop. "�' The transformers will be housed in a Pacific Utility Products enclosure. The dimensions of this enclosure are 31" tall x 25.42" wide x 16.98" deep. They are fully rated for outdoor use, � lockable, and will keep the transformers above grade to avoid being compromised by soil and water contact. (Transformers were viewed at the site which suffer these conditions.) Each enclosure shall be mounted on a concrete pedestal which will be 4 inch minimum thickness , '�"" poured in place. They are shipped a standard green color which can be painted at your discretion. There will be extra space available within each enclosure to allow additional � equipment to be housed within, and spare conduits will be installed at each location to allow future expansion, such as receptacles for the light poles, which were omitted at this time. Cove Electric shall approach each median one at a time from the power source to the end � of line. Setting the enclosures will be the only time work will be spread out the length of the project. Existing conduits shall be utilized wherever possible, and empty 2" conduits were ..� viewed throughout. All existing conduits will be vacated pneumatically prior to conductor installation using Co2. All new conduits and related wiring shall be as specified in the key information book, and installed to the standards of the national electrical code. Particular � attention will be extended to wire size, (no smaller than 10 awg) burial depth (no less than 18 inches) , and conduit fi1L (no conduit shall be smaller than 3/ inch.) � Receptacles will be mounted in an Arlington post , which is available in a one or two receptacle configuration. Receptacles will also be protected by "in use" covers to allow protection from the elements while the receptacle is being utilized. The post's come with +� stabilizers for a stronger finished sturdiness. All labor and materials furnished shall be guaranteed for one year upon completion of the project. Services relative to their trade will be utilized in both concrete, and landscape work. This � will allow us to perform professional landscape restoration, and irrigation repair if need be.
