TEMPORARY CERTIFICATE OF OCCUPANCY
Temporary Certificate of Occupancy procedure:
Note: All written requests require (3) to (5) working days to process.
1.The Applicant is required to complete the attached application for a Temporary Certificate of Occupancy
(TCO). The property owner and/or contractor must sign the TCO Application before submitting it for
consideration.
2.The Applicant may request and schedule a TCO and/or Final Building Inspection with their building
inspector of record or the Chief Inspector. The inspection will determine feasibility and field procedural
guidance.
3.The Applicant will need to contact the appropriate City Divisions identified by the Inspector of Record and
schedule an inspection (i.e. Planning, Fire Marshall’s Office, Health, and Public Works (All, if applicable).
4.The reviewing Divisions will indicate approval or denial electronically in the City’s permitting software.
5.A TCO is granted for a period determined by the Chief Building Official or their designee.
6.The Contractor/Owner is required to proceed in good faith to obtain final inspection approval(s), as
applicable, from Building, Fire, Public Works, and Planning, on or before the expiration date listed on the
TCO. Failure to obtain a permanent Certificate of Occupancy or approved extension by the date stipulated may
result in a suspension of utilities serving the property, TCO revocation, and/or applicable legal
proceedings.
7.The applicant may be required to post a Performance Bond or Cashier’s Check (amount to be determined by
the Chief Building Official or as identified by other City Divisions). All outlined work must be completed prior to
the expiration date of the TCO contract. In the event the applicant fails to complete the outstanding work, the
City shall call on the Performance Bond/Cashier’s Check to ensure that the work will be completed to
the satisfaction of the City. (PDMC 25.60.150)
8.When the Building and Safety Division receives all City and County Department final approvals, a final
Certificate of Occupancy will be issued.
Under the California Building Code, temporary occupancy of commercial or industrial buildings and
new single-family residences may be issued when the project has not received its final inspection.
The Chief Building Official, or their assigned staff member, may issue a temporary occupancy permit
when the findings support that no substantial life, safety, or health hazards exist by allowing this
temporary occupancy.
Before approving a temporary occupancy permit, the Building and Safety Division staff will verify that
all required approvals, including but not limited to, Planning, Fire Marshall’s Office, Health Department,
and Public Works are obtained or deferred to the final inspection. A building inspector will inspect the
building to verify that it is safe for occupancy. Additional work or corrections to existing work may be
required before temporary occupancy is approved. In no case shall the building be occupied until the
Chief Building Official, or their assigned staff member, has approved.

If you fail to do this prior to the expiration of your TCO, you must vacate the premises and terminate all temporary occupancy until the
renewal of a TCO is approved or you obtain a final Certificate of Occupancy for the building. All fire-life safety requirements must remain in
place at
all times.
Extension considerations will be on a case-by-case basis. Please submit a revised TCO Application 5 working days prior to
expiration.
In consideration of the granting of such temporary use, the undersigned waives any cause of action against the City of Palm Desert or
any officers or employees thereof, because of any defect in building construction, installation of gas or electrical equipment, or for any
other defect in connection to or disconnection from any utilities which may cause any damage whatsoever to the premises, any other
premises, or any person or persons. The undersigned further agrees to hold the City of Palm Desert or any officers or employees
thereof, harmless from any liability caused by such temporary clearance. I further acknowledge that the issuance of a Temporary
Certificate of Occupancy requires that the completion of construction be done in a timely manner and that all utilities may be turned off
for any hazardous conditions or for not completing the construction.
