Construction Waste Diversion Program Construction and Demolition (C&D) waste accounts for 29% of materials going into landfills. The City of Palm Desert is mandated by State law to help reduce the amount of material hauled to landfills through the California Green Building Code (CALGreen). The City has created a process to make compliance easy through the C&D Diversion Program, and it all starts with a Construction Waste Management Plan. A Construction Waste Management Plan (CWMP) is necessary to demonstrate compliance with State regulations for your C&D project. A CWMP ensures that C&D projects salvage, reuse, or recycle all inert solids (for example concrete, drywall, brick, asphalt, glass, plaster, and clay) and divert at least 65% of all other debris generated by your project. This 65% diversion requirement, including 100% diversion of land clearing debris (for example dirt, rock, and landscape material), is a mandatory requirement of CALGreen. Projects Required to Submit a Construction Waste Management Plan The following projects are required to submit a Construction Waste Management Plan and comply with CALGreen: Residential Newly constructed low-rise and high-rise residential buildings such as: Hotels, motels, and lodging houses. Apartments and condominiums. One and two-family dwellings and townhouses. Dormitories, shelters for homeless people, congregate residences, and employee housing. Other types of dwellings containing sleeping accommodations with or without common toilets or cooking facilities. Factory-built housing. Accessory Dwelling Units (ADU) built in accordance with the California Building Standards Code. Live/Work Units. Accessory structures serving residential buildings. Additions or alterations of existing residential buildings where the addition or alteration increases the building's conditioned area, volume, or size. The CALGreen requirements are only applicable within the specific area of addition or alteration. Commercial or Non-residential Newly constructed buildings. Building additions of 1,000 square feet or greater. Building alterations with a permit valuation of $200,000 or above (for occupancies with the California Building Code). Code requirements for additions and alterations shall only apply to the portions of the building being added or altered within the scope of the permitted work. Note: Minor electrical, plumbing, and mechanical permits are exempt. Instructions When Applying for a Building Permit When applying for a building permit, please make sure to include a completed CWMP, which must be provided to the City's Development Services Center. For free assistance and guidance in complying with State regulations, please contact the City of Palm Desert's District Environmental Coordinator at tel:17606741026(760) 674-1026 from Burrtec. During Your Project Provide monthly recycling progress reports to and stay in contact with the District Environmental Coordinator. At the end of the job, both the property owner and/or contractor will be provided a final recycling report showing the overall recycling rate of the project. Prior to Issuance of Certificate of Occupancy or Final Inspection The project's final diversion report, to be approved by Burrtec, must be uploaded to your Clariti account through the https://palmdesert.my.site.com/s/. Important final report requirement A Certificate of Occupancy, Temporary Certificate of Occupancy, or Final Inspection will not be scheduled or issued without submitting a final approved diversion report from Burrtec to the City. Self-Hauling Clean-up companies and other haulers are not permitted to haul waste or recyclables from the City of Palm Desert without a Self-Hauling Permit. If you choose to self-haul any materials, including recyclables or trash, follow the requirements below. When Applying for a Building Permit for Self-Hauling When applying for a building permit, please make sure to include a completed CWMP, which must be provided to the City's Development Services Center. Reminder: Burrtec Waste & Recycling is the exclusive franchised hauler for the City of Palm Desert. Construction Waste Management Plan (CWMP) The City of Palm Desert adopted the 2022 California Green Building Standards Code as part of Ordinance 1388. This Code and Ordinance requires that builders and contractors recycle and/or salvage a minimum of 65% of the non-hazardous construction and demolition debris, or meet a local construction and demolition waste management ordinance, whichever is more stringent. Acknowledgments requiring applicant initials I have read and understand the scope of the City of Palm Desert's Construction Waste Management Program. Applicant initials for acknowledgment 1 I understand that I am required by Palm Desert Ordinance No. 1388 to recycle and/or salvage for reuse a minimum of 65% of the non-hazardous construction and demolition debris or meet a local recycling and waste ordinance, whichever is more stringent. Applicant initials for acknowledgment 2 I understand that I am required by Palm Desert Ordinance No. 1388 to recycle and/or salvage for reuse a minimum of 100% diversion of land-clearing debris (for example dirt, rock, and landscape material). Applicant initials for acknowledgment 3 I understand that failure to meet the requirements of Ordinance No. 1388 shall constitute a misdemeanor and shall be punishable by imprisonment in the county jail for up to 6 months, or by a fine of up to $1000, or both. In addition, a stop order on the job or a delay of final approval may occur. Applicant initials for acknowledgment 4 At the completion of this project, or more frequently if required, all receipts or other equivalent documentation from salvage, recycling, and waste facilities will be coordinated with Burrtec. I understand that I may not be issued my final inspection unless the final diversion report from Burrtec is submitted to the Building and Safety Division. Applicant initials for acknowledgment 5 Step 1: Project Information - Fill Out the Following Information This Construction Waste Management Plan (CWMP) must be completed with a building permit application to obtain a building permit. Separate CWMPs must be completed for demolition if conducted before a building permit is issued. Only one CWMP is necessary if demolition and construction are under the same permit.
