Construction and Demolition (C&D) waste makes up 29% of materials going into
landfills. The City of Palm Desert is mandated by State law to help reduce the
amount of material that is hauled to landfills through the California Green Building
Code (CALGreen). The City has created a process to make your compliance easy
through the C&D Diversion Program and it all starts with a Construction Waste
Management Plan.
A Construction Waste Management Plan (CWMP) is necessary to demonstrate
compliance with State regulations for your C&D project. A CWMP ensures that
C&D projects salvage, reuse, or recycle all inert solids (i.e. concrete, drywall, brick,
asphalt, glass, plaster, clay, etc.) and divert at least 65% of all other debris
generated by your project. This 65% diversion requirement, including 100%
diversion of land clearing debris (i.e. dirt, rock, landscape material, etc.), is a mandatory
requirement of the CALGreen requirements: (See Palm Desert Environmental Programs!!)
The following projects are required to submit a Construction Waste Management
Plan and comply with CALGreen:
Residential
1.Newly constructed low- and high-rise residential buildings such as:
•Hotels, motels, and lodging houses.
•Apartments and condominiums.
•One and two-family dwellings and townhouses.
•Dormitories, shelters for homeless people, congregate residences, and employee
housing.
•Other types of dwellings containing sleeping accommodations with or without
common toilets or cooking facilities.
•Factory built housing.
•Accessory Dwelling Units (ADU) built in accordance with the California Building
Standards Code.
•Live/Work Units.
•Accessory structures serving residential buildings.
2.Additions or alterations of existing residential buildings where the addition or
alteration increase the building’s conditioned area, volume, or size. The CALGreen
requirements are only applicable within the specific area of addition or alteration.

Commercial or Non-residential:
1.Newly constructed buildings.
2.Building additions of 1,000 square feet or greater.
3.Building alterations with a permit valuation of $200,000 or above (for occupancies
within the California Building Code.
Note: Minor electrical, plumbing, and mechanical permits are exempt.
Instructions:
Prior to issuance of permit: A completed CWMP must be provided to the City's Permit
Center for review and approval. Contact the City of Palm Desert’s District Environmental
Coordinator from Burrtec at (760) 674-1026 for free assistance and guidance toward
compliance with State regulations.
During Your Project: The District Environmental Coordinator will stay in contact with
you throughout your project and will provide monthly recycling progress reports. At the
end of the job, both the property owner and contractor will be provided a final recycling
report showing the overall recycling rate of the project.
Prior to issuance of Certificate of Occupancy or Final Inspection:The project’s final
diversion report, to be drafted by Burrtec, will be forwarded to the City’s Building &
Safety Division for approval at building@palmdesert.gov
A Certificate of Occupancy cannot be issued or Final Inspection approved
without submitting a final diversion from Burrtec to the City.
Self-Hauling
If you choose to self-haul any materials including recyclables or trash, you will need to
complete and submit a CWMP and will be required to provide copies of all weight tickets
and/or receipts from the transfer station, landfill, or recycler monthly to Burrtec to
ensure compliance with the City’s program and proper waste disposal and
diversion efforts. Clean-up companies and other haulers are not permitted to haul
waste or recyclables from the City of Palm Desert. Not meeting the CALGreen 65%
percent diversion goal may result in enforcement by the City per the municipal code
section 15.18.010. Self-haul weight tickets will be used to draft the required
monthly and final diversion reports needed to receive your Certificate of
Occupancy and should be submitted to: Renado Gouldlock, District Environmental

REMINDER: Burrtec Waste & Recycling is the exclusive franchised hauler for the
City of Palm Desert. It is illegal for clean-up companies and other haulers to haul
waste from your project. Self-hauling is allowed under certain conditions.

The City of Palm Desert adopted the 2022 California Green Building Standards Code as part of
Ordinance 1388. This Code and Ordinance requires that builders/contractors recycle and/or
salvage a minimum of 65% of the non- hazardous construction and demolition debris, or

stringent.
